Welcome to Ultimate Gifts. These Terms and Conditions govern the use of our website and the purchase of products from Ultimate Gifts. By accessing our website or placing an order, you agree to these terms.
1. General Information
Ultimate Gifts operates as an online-only retail store based in South Africa, offering curated gift items prepared after an order is placed.
All transactions are subject to the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).
Nothing in these terms is intended to limit or waive any rights afforded to consumers under South African law.
2. Product Information & Availability
We make every effort to display product descriptions, images, and pricing accurately. However:
- Product colours, packaging, or finishes may vary slightly due to lighting, screen settings, or supplier changes.
- All products are subject to availability.
- Orders may be cancelled if a product becomes unavailable, in which case a full refund will be issued.
3. Pricing & Payment
- All prices are displayed in South African Rand (ZAR).
- Prices may change without prior notice.
- Full payment is required before an order is processed.
Ultimate Gifts reserves the right to refuse or cancel orders suspected of fraud or misuse.
4. Order Processing & Delivery
- Orders are processed after payment confirmation.
- Estimated delivery time is 8–11 working days from order confirmation.
- Delivery is handled via Aramex Door-to-Door within South Africa.
Delivery timelines are estimates and may be affected by factors outside our control, including courier delays or public holidays.
5. Returns, Refunds & Consumer Rights
Ultimate Gifts complies fully with the Consumer Protection Act.
Customers are entitled to receive goods that are:
- Of good quality
- Free from defects
- Fit for their intended purpose
If a product is defective, damaged, or incorrect:
- The issue must be reported within 48 hours of delivery
- The customer may choose a repair, replacement, or refund, as provided by law
Returns are not accepted for:
- Change of mind
- Incorrect product selection by the customer
- Normal wear and tear
- Minor variations that do not affect product functionality
6. Cooling-Off Period (ECTA)
In accordance with the Electronic Communications and Transactions Act, customers may cancel certain online transactions within the legally prescribed cooling-off period, unless the product falls under exemptions permitted by law.
Where applicable, refunds will be processed within 5–10 working days after approval.
7. Allergic Reactions & Sensitivity Disclaimer
Some products sold by Ultimate Gifts may contain materials, metals, coatings, fragrances, or components that could cause allergic reactions or sensitivities.
- Customers are responsible for reviewing product descriptions carefully before purchase.
- Ultimate Gifts cannot guarantee that products are hypoallergenic unless explicitly stated.
- Ultimate Gifts shall not be held liable for allergic reactions, sensitivities, or adverse responses resulting from product use, except where required by law.
This clause does not limit any rights afforded under the Consumer Protection Act.
8. Loss, Damage & Courier Liability
Once an order has been handed over to the courier:
- Ultimate Gifts is not responsible for delays caused by the courier
- Risk transfers to the courier during transit
- We will assist customers in lodging claims or tracking parcels where possible
Ultimate Gifts shall not be held liable for indirect losses, consequential damages, or loss of income arising from delivery delays or courier-related issues, except where prohibited by law.
9. Limitation of Liability
Ultimate Gifts shall not be liable for:
- Misuse of products
- Failure to follow care or usage instructions
- Indirect or consequential losses
This limitation applies only to the extent permitted under South African law.
10. Intellectual Property
All website content, including text, images, branding, and logos, is the property of Ultimate Gifts and may not be used, copied, or reproduced without written permission.
11. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.
